RE: Cape Town High Court rules unanimously in favour of the South African Junior Golf Association

 

The South African Junior Golf Association wishes to inform you of the following facts;

  • The High Court battle between the South African Junior Golf Association (SAJGA) and South African Golf Association-(SAGA) who claimed monopoly over golf in South Africa was unanimously won by the South African Junior Golf Association with cost.(see attached court order)
  • CIPRO’s order directing the SOUTH AFRICAN JUNIOR GOLF ASSOCIATION to change its name is set aside.
  • SAGA’s application for an interdict against the SOUTH AFRICAN JUNIOR GOLF ASSOCIATION prohibiting them utilizing the name is dismissed with cost.
  • SAGA’s counter application capturing the name instead is dismissed with cost.

 

Our question is, should the SAGA as National Golf Body, its President and board of directors be called to task after spending a good part of R1 000 000.00 ( 1 million) of unauthorised money.

 

The High Court battle was as a result of SAGA’s choice to opt for the Cape Town High Court as they refuse to accept the independent existence of the South African Junior Golf Association and attempted to register the same name for themselves in the mitts of proceedings.

 

Judge the facts for yourself:

  • SAGA caused the unnecessary High Court battle and should they be held responsible for wasting R1 million of funds that could have been spent on mass development of children’s golf.
  • R1 million will have to come from SAGA coffers that stems from donations of national golf clubs and its members who pays affiliation fees.
  • SAGA did not have authorization or the mandate from national golf clubs to utilize such funds on a court case that could have been avoided.
  • Despite our correspondence with SAGA since 2006 they refused to enter into talks.
  • Our proposals were ignored and not even considered.   
  • SAGA embarrassed its members, clubs, National, International golf community and SASCOC.
  • SAGA Sponsorships are placed in jeopardy.
  • Three months before trial date SAGA granted us a meeting that took place on June 9th 2009, Westlake Golf Club, Cape Town.

Our presented agenda included the following however brushed off the table and was not considered.

  • Our correspondence with SASCOC, Mr. Gideon Sam, President of the South African Sport Confederation Olympic Committee reveals that all variation of golf in South Africa should fall under one umbrella and required national bodies to adhere.
  • Mass development of Children’s golf.
  • Affiliation.
  • Mass children’s competition play. 
  • Meeting was chaired by SAGA President Mr. Enver Hassen and national Board of Directors.
  • Also present was the WPGA President Ivan Palferman and his board of directors who revealed they know nothing of such court case. 
  • SAGA President claimed that all golf associations in SA are affiliated to them and thus owns and dictate golf in SA.
  • SAGA claimed that our junior golf association is unlawful therefore should not exist.
  • SAGA further claimed that we infringing in their business, despite being aware of the fact that we are a legal registered trade mark and registered section 21 company certified by CIPRO.   
  • SAGA further claimed that we transgress under the Passing Off Law.
  • SAGA also claimed that we ride on their goodwill, reputation, and cause deception.

 

SAGA ‘s President and Board of Directors are fully aware of the facts and legal existence of our junior association. SAGA knowingly ignored SASCOC President Gideon Sam’s call for the unification of all golfing codes to be brought under one umbrella body.

 

South African Junior Golf Association’s involvement

The South African Junior Golf Association and the Johan Engelbrecht Golf School International is currently working hand in hand with Western Cape Province Sport, Recreation and Amenities District 2.

Our 12 Golf Regions across South African includes the Western Cape Province, the first province to benefit from our initiative. We have successfully initiated golf to +- 8 000 children in ten district two schools, coordinated 28 West Coast Schools with a capacity of +- 20 000. Coordinated 11 schools in Mannenberg with a capacity of +- 9 000 as well as schools in Boland and Northern Suburb. Also well advanced in introducing our initiative in Mitchell’s Plain and Atlantis with +- 30 000 children to be accommodated.  

Our latest success is the young Reginald Adams from Black Heath, Kuils River who was taken up in our grass root golf development programme at age thirteen and more than R500 000.00 was invested in Reginald’s golf development process. He turned pro at age 20 and is a successful professional golfer competing on the SA PGA Sunshine Tour. As amateur golfer Reginald won the South African Amateur Match Play Championship (Plate).

 

GOVERMENTAL NEGOTIATIONS

The South African Junior Golf Association has been extensively involved in high level negotiations with the departments of Education and Sport.

 

May 2007, The SAJGA directorate has met and briefed the MEC of Western Cape Education, Mr. Camron Dougmore in May 2007 regarding golf as official school sport throughout South African Schools with starting point in the Western Cape Province.

 

November 2007, The SAJGA directorate has also met and briefed the Head of the Ministry of Cultural Affairs, Sport and Recreation in November 2007. Present at that meeting was the Head, Mr. De Allende, acting director, Me. Megan Bam, myself and members of SAJGA directorate.

 

On March 17th , 2008 a meeting was held between the Ministry of Cultural Affairs, Sport and Recreation, Mr. Justin De Allende Head, Western Cape Manager of School Sport and Mass Participation Mr. Bobby Cassiem as well as the directorate of the SAJGA.

 

On May 19TH , 2008  Mr. Bobby Cassiem, Western Cape Manager of School Sport and Mass Participation, was presented with final documentation regarding our national vision.

 

July 5th 2008, Further meetings was held regarding initiating golf as a new sport code in the Western Cape Sport School with Head of his Department Mr. Weitz on July 5th 2008.

  

August 31st , 2009, High level governmental meetings was also held with Western Cape Provincial Minister of Sport, Mr. Sakkie Jenner at his office which took place on August 31st , 2009.

September 1st , 2009 with Northern Cape Province Minister of sport Me. Pauline Williams introducing our mass development of children’s golf as an official school sport.

SAJGA directorate is corresponding with South African Sports Confederation and Olympic Committee (SASCOC) since February 2009 regarding its membership and awaits endorsement.   

SAJGA directorate, during 2010 has had several discussions with South African Golf Association and has been offered recognition status. Conclusion and common ground for a working relationship is still pending.

February 2011, A meeting between the directorate of the South African Junior Golf Association and the Deputy Minister of Sport Mr. Gert Oosthuizen was positively received regarding its vision.

June 2012, a follow up meeting between the directorate of the South African Junior Golf Association and the Deputy Minister of Sport Mr. Gert Oosthuizen was held where the urgency of unification between all golfing bodies in South Africa and grass roots mass development of children's golf were taken a step higher with promises of ministerial intervention.

 

 SHORT HISTORICAL BACKGROUND

The South African Junior Golf Association (SAJGA) was founded in 2001 and is affiliated to the South African Schools Golf Association(R)TM, Johan Engelbrecht Golf School International and Just Think,,, group of golf companies. SAJGA founder and President, Johan Engelbrecht is a AAA Member of the Professional Golf Association of SA, full member of the Professional Golf Association Sunshine Tour of SA.

 

SAJGA ‘s main business is grass root mass development of children’s golf by introducing golf as official school sport at all SA schools and to develop school mashie golf courses, thereby creating a pool of young development players feeding the main stream of golf in South Africa. This current process already produced many young players who has been fed into the main stream of golf on club, junior, premier, provincial, springbok and professional level and crowned as multiple touring champions as well.

 

Our constitution also pre-empt our commitment to co-ordinate, promote, advance, elevate and expand children’s golf, in age groups 4-18, including all races, genders, sexes, religions, consciences, beliefs, cultures, languages, and ethnic or social origins. 

 

Our holistic approach includes, not only golfing skills but also to prepare children for the golf labor market educating them regarding, life skill values, education, fostering a positive attitude, influencing the child’s mind physically, mentally as well as spiritually. Also teaching them not succumbing to negative trends like alcohol and drug abuse, HIV/AIDS, teenage pregnancies, gangsterism and crime.

Our twenty-five years collective experience in amateur and professional golf development is ploughed back into children’s golf and believes that our association fills that void in South African Rainbow Nation.

The South African Junior Golf Association PATENT & TRADEMARK

  • Application for the South African Junior Golf Association’s trademark was filed in 2001 and was accepted and published in the Patent and Trademark Journal in 2006 – reg. no. 200116449.
  • The South African Junior Golf Association Patent and Trademark certificate was issued on 15 January 2008, Trade Mark no. 2001/16451.
  • The SAJGA is a section 21 non-profit organization – registration no.2006/026422/08 from no. 61 of 1973.
  • The SAJGA is a registered fund-raising association with registration no. 054-602, granted by the Republic of South Africa, Department Social Development in terms of act, 71 of 1997.
  • SAJGA’s bank account is at Standard Bank, N 1 City, Acc no. 2800 445 85, Code 031110.

  • A four man board of directors manages the afairs of the SAJGA.
